Suddenly housebound: that is primarily the reason why I decided to try affiliate marketing all of the sudden. What is CAN-SPAM Law?

The CAN-SPAM law, officially known as the CAN-SPAM Act of 2003, is a law that became effective beginning the first of January 2004. It provides the legal requirements for people who send commercial email, sets penalties for spammers and companies whose products and services are advertised in spam the moment they violate the law, and gives consumers the right to ask the people responsible for the email to stop spamming them.

Companies that offer Internet access may also run after and sue violators of the law.

The CAN-SPAM Act sets several requirements. The main provisions of the law deal with header information, subject lines, opt-in and opt-out methods, identification of commercial email, and inclusion of sender’s valid physical postal address.

To elaborate, the law requires that false or misleading header information be banned. This means that the information about the sender, recipient, and routing information – which includes the originating email address and domain name – must be precise or accurate and that the person who sent the first email be identified properly. In the same way, the law requires that deceptive subject lines be prohibited. This means that the subject line must not contain information that can deceive or mislead the recipient about the content of the email.

People who have opt-in lists should check their opt-in programs for possible violations of the law. A return email address or any other Internet-based response mechanism allowing the recipient to express his desire to have the sending of emails to his email address be stopped must be provided. Thus, an opt-out system which allows the subscriber to end further commercial email communication from the sender, should be provided for in the opt-in menu. Moreover, the opt-out system must process the opt-out request for a minimum of thirty days. Once an opt-out request is received, the sender must stop sending email to the person requesting the opt-out within ten days.
